Provisional Unlawful Presence Waiver Application Approved by USCIS

Foreign National client sought to obtain a greencard in the United States. A greencard is the official document that gives a foreign national person permission to permanently live and work in the United States. When a foreign national person enters the United States unlawfully and then subsequently applies for a greencard based on marriage to either a U.S. citizen or a Lawful Permanent Resident (“LPR”) (i.e., a greencard holder), the foreign national person must first file a Provisional Unlawful Presence Waiver Application. This waiver essentially asks the U.S. government to forgive the foreign national person for unlawfully entering the United States. This type of waiver is very difficult to get approved. A Provisional Unlawful Presence Waiver Application requires a foreign national person to be able to prove that his or her U.S. citizen or LPR spouse would be unable to live a comparable life in the foreign national person’s home country compared to living in the United States. If the waiver is approved, the foreign national person will then be eligible to attend a greencard interview at a U.S. Embassy or Consulate located in the foreign national person’s home country. Mrs. Huff prepared the appropriate Forms and presented sufficient evidence to USCIS and was able to get our client’s Provisional Unlawful Presence Waiver Application approved. This, in turn, allowed our client to obtain a greencard.

Reckless Driving (99/55) Dismissed in Virginia Beach, VA

Client was charged with the criminal offense of Reckless Driving (99/55) in Virginia Beach, VA. If anyone is convicted at this speed, judges will strongly consider imposing an active jail sentence. Mr. Huff went to trial on the case and the judge found our client not guilty and dismissed the charge.

Reckless Driving (86/55) Reduced in Northampton County, VA

Client was charged with the criminal offense of Reckless Driving (86/55) in Eastville, Northampton County, VA. Client is from New Jersey and Mr. Huff was able to resolve the case without our client having to appear in court. Mr. Huff presented mitigating evidence to the judge and was able to get our client's charge reduced to a non-criminal offense, which rarely happens at a speed this high in the Northampton General District Court.

Greencard Application Approved by USCIS

DUI Conviction Avoided in Williamsburg, VA

Client was charged with Driving Under the Influence (“DUI”) in Williamsburg, VA. A conviction of DUI in Virginia can have consequences such as active and suspended jail time for a maximum of 12 months, suspension of your driver’s license for 12 months, installation of an ignition interlock system in your vehicle for a minimum of 6 months, a fine, alcohol and substance abuse education and/or treatment, demerit points on your driving record, increased auto-insurance rates and difficulties with employment. This case was an appeal in the Circuit Court as our client lost his first DUI trial with a different attorney. After retaining our law firm, Mr. Huff went to trial on the case and the judge found our client not guilty of DUI and amended our client's charge to a non-DUI offense.
